The Economic Cooperation Office of the Yunnan Provincial People¡¯s Government The Economic Cooperation Office of the Yunnan Provincial People¡¯s Government (hereinafter called ECO) was established on October 29th, 2002, by the approval of the Yunnan Provincial People¡¯s Government. This office is an institution directly under the provincial government and is responsible for inviting business and introducing foreign investment into the province, as well as for organizing and enforcing the opening-up of the province to the rest of the country and to the outside world. It is also the work institution of the Yunnan Provincial Commission on Foreign Investment, and it handles daily affairs of the commission. Its main responsibilities are: 1. The implementation and enforcement of the principles and policies of the state and the work plans of the Provincial CPC Committee and the Provincial Government on the utilization of foreign investment; 2. Being responsible for handling the daily affairs of the Provincial Commission on the Foreign Investment; Coordinating and dealing with the issues in the work of inviting business and foreign investment to the province and of the economic and social cooperation. 3. The objectives of the service building The Yunnan provincial foreign investment service building is an important measure adopted by the province for the further expansion of the opening-up to the outside world and the increasing utilization of foreign investment. It is also an important measure for the change of government functions, the improvement and openness of the government administration, and the improvement of investment environment. With the aim of ¡°open handling of administrative affairs, transparent operational procedure, standardized work regulations, and streamlined work structure¡±, by providing investment consultancy service, handling investment approvals, and providing excellent, efficient, uniformed, and standardized services to foreign investment enterprises, the service building serves as a modal of foreign investment environment improvement in the whole province. The Provincial Economic and Trade Cooperation Office is responsible for the organizational work and a leading department in the service building. 2. The responsibilities and requirement of the service building (1). The responsibilities of the service building. The responsibilities are providing good investment policy consultancy work, and handling all the approval formalities required of the foreign investors intended to invest in Yunnan province. All those approvals related to the responsibility of the provincial government are to be handled in the service building. For those projects to be processed at the provincial level, all the formalities related to the establishment of enterprises, as well as the related approval work on the provincial level concerning the starting of construction and the production and management will be processed centrally in the service building. For projects to be approved on the prefectural levels, the relevant formalities requiring the provincial level approval concerning the starting of construction and the production and management will be also handled in the building. (2). The work requirement. Project approval formalities which should be handled in the building will be accepted and handled by the relevant government functional departments in the building. The working staff of all the composing departments in the building will undertake the receiving, transferring, following-up, coordinating, and approving of the application within their own scopes of departmental responsibilities. 3. The composing departments in the service building.
The united offices of the service building is composed of by the following departments: the Provincial Economic Cooperation Office, the Provincial Development Planning Commission, the Provincial Economic and Trade Commission, the Provincial Foreign Trade and Economic Cooperation Department, the Provincial Department of Finance, the Provincial Department of Construction, the Provincial Department of Supervision, The Provincial Department of Land and Resources, the Provincial Department of Labour and Social Security, the Provincial Administration for Industry and Commerce, the Provincial Environmental Protection Administration, the Provincial Bureau of Quality and Technical Supervision, the Provincial State Taxation Administration, the Provincial Local Taxation Administration, the Provincial Administration of Foreign Exchanges, and the Kunming Customs. Other departments and agencies like the Public Security Bureau, Fire Brigade, the Personnel Department, the Cultural Department, and Health Department will not join the united office. But any work related to these departments will be transferred to the relevant department after handled by the approval leading department in the building and must be handled within the specified timing limit. 4. The responsibilities of each department.
(1). The Provincial Economic Cooperation Office: a. Taking the lead and responsible for the daily management of the service building; b. Conducting coordination if different opinions arise towards important projects on the provincial level between two or more than two departments; c. Responsible for the supervision on the timing limit and promises for project approval service; d. Responsible for policy consultancy of foreign investment utilization; e. Introduction to visiting foreign investors of the projects inviting foreign investment in Yunnan; f. Responsible for work achievements checking of the working staff dispatched to the service building by the various government departments. (2). The Provincial Development Planning Commission: a. The approving of the project proposal and feasibility study of foreign investment project on infrastructure at the provincial level; b. The checking and reporting to the central government level on the project proposal and feasibility study of foreign investment project on infrastructure to be approved at the state level; c. The issuance of registration card on fee collection to foreign investment enterprises. (3). The Provincial Economic and Trade Commission: a. The approving of the project proposal and feasibility study of the technical renovation projects using foreign investment at the provincial level; b. The checking and reporting of the project proposal and feasibility study of the technical renovation projects using foreign investment to be approved at the state level; c. Coordinating with other relevant departments to solve the difficulties and problems of foreign investment enterprises in their production and management. (4). The Provincial Department of Foreign Trade and Economic Cooperation a. The approving of the business contract and the articles of incorporation of the foreign investment enterprises, and the issuance of the approval certificate of the foreign investment enterprises at the provincial level; b. The checking and reporting to the central government on the business contract and the articles of incorporation of the foreign investment enterprises to be approved at the state level; c. The checking and management of the import and export quotas and licenses to the foreign investment enterprises; d. The handling of the alteration and suspension of the business contract and the articles of incorporation, and of the financial settlement of the foreign investment enterprises; e. The issuance of ¡°Confirmation on Domestic and Foreign Investment Project encouraged by the State¡± to the qualified foreign investment enterprises. (5). The Provincial Department of Finance: a. The handling of the financial registration and the alteration of registration of foreign investment enterprises located in Kunming at the provincial and state approval levels; b. Responsible for the consultancy and explanation of the state and provincial policies on financial and accounting affairs. (6). The Provincial Department of Construction: a. The qualification checking and the issuance of licenses to foreign investment enterprises engaged in projects on real estate development, construction engineering, survey and designing, interior decoration and renovation; b. The handling related formalities concerning planning and construction belonging to the provincial management; c. Coordinating to resolve the difficulties and problems of the foreign investment enterprises at the construction stage. (7). The Provincial Department of Supervision: a. The setting up of offence informant box to handle the complaints from the foreign investment enterprises, and being responsible for the coordinating, supervision, and feed back of the related complaint; b. The handling of the complaints related to the work quality and work style of all the offices in the building by the visiting guests, and coordinating with the Provincial Economic Cooperation Office to supervise the relevant departments to rectify and reform. (8). The Provincial Department of Land and Resources: a. The handling of all the application formalities on the issue of land acquisition and land utilization of the foreign investment enterprises; b. The handling of the application of foreign investors and foreign investment enterprises to be engaged in the prospecting, exploitation, and mining of mineral resources; (9). The Provincial Department of Labour and Social Security: a. Coordinating and handling the application formalities of foreign investment enterprises in their advertisement for employment; b. Coordinating and handling of the application formalities of foreign investment enterprises in employing personnel from overseas, Taiwan, Hong Kong, and Macao; c. Coordinating and handling the employment registration formalities of Chinese personnel by the foreign investment enterprises. (10). The Provincial Administration of Industry and Commerce: a. The handling of the approval to the company names of the foreign investment enterprises; b. Responsible for the checking of relevant formalities related to the industrial and commercial registration, and the issuance of business licenses of the foreign invested projects at the provincial management level; c. The handling of the registration formalities of the foreign investment enterprises fitting the direct registration criteria; d. The handling of the alteration and suspension of related formalities of the foreign investment enterprises. (11). The Provincial Environmental Protection Administration: The examining and approving of the environmental protection aspect of the construction projects by the foreign investment projects (including the environmental effect report, charter and registration of the foreign investment enterprises) (12). The Provincial Bureau of Quality and Technical Supervision: a. The application, alteration, re-issuance, change, and canceling of the organization code certificate of the foreign investment enterprises, and the regular checking of the code certificate; b. The policy consultancy and explanation related to issues on the quality and technical supervision. (13). The Provincial State Taxation Administration: a. The consultancy, explanation, and related services on the policies of state taxation; b. Responsible for the coordination, supervision, and execution of issues related to taxation; c. The handling of the reports on the illegal cases and complaints related to taxation. (14). The Provincial Local Taxation Administration: a. The handling of the registration affairs concerning local taxation; b. Coordinating and carrying out the affairs concerning the policy consultancy on local taxation and matters related to local taxation. (15). The Provincial Administration of Foreign Exchange; a. The approving and issuance of the foreign exchange registration certificate to the foreign investment enterprises; b. The approving of the opening up of foreign exchange account and of the capital settlement of foreign exchanges: c. The handling of the related formalities concerning overseas loans for foreign investment enterprises. (16). The Kunming Customs: a. The handling of the customs registration and the issuance of the customs certificate; b. Providing consultancy of the customs policy and the coordination of matters related to the customs; c. The handling of relevant formalities concerning the importation of equipments for foreign investment. The annual checking up of foreign investment enterprises will be handled at relevant offices inside the service building by the 8 related governmental functional departments: the Provincial Economic and Trade Commission, the Provincial Department of Foreign Trade and Economic Cooperation, the Provincial of Finance, the Provincial Administration of Industry and Commerce, the Provincial State Taxation Administration, the Provincial Local Taxation Administration, the Provincial Administration of Foreign Exchange, and the Kunming Customs.
5. The management of the operation of the service building
The Provincial Office of Foreign Investment organizes, coordinates, and manages the service building, and is responsible for the supervision of the promised undertaking of the services, which will be executed according to the principle of unified offices, unified operation to the public, executing each other¡¯s own responsibilities, and integrated coordination. Departments joining the united office will fulfill their own responsibilities within the specified time limite. (1). The organizational structure There are 16 work rooms set up in the service building: the Foreign Investment Room, the Planning Room, the Economic and Trade Room, the Foreign Trade and Economic Cooperation Room, the Industrial and Commercial Room, the Environmental Protection Room, the Customs Room, the State Taxation Room, the Local Taxation Room, the Labour Room, the Land and Resources Room, the Financial Room, the Foreign Exchange Administration Room, the Supervision Room, the Construction and Planning Room, the Quality and Technical Supervision Room. (2). The management of the working staff of the service building a. The working staff of the service building is from the relevant provincial functional departments. The numbers of working personnel in the building from each department are determined according to the work volume, normally no less than 2 persons. Among all the participating departments, because of the larger work load of the Provincial Development Planning Commission, the Provincial Economic and Trade Commission, the Provincial Foreign Trade and Economic Cooperation, the Provincial Administration of Industry and Commerce, the Provincial Department of Land and Resources, the Provincial Department of Construction, the Provincial Administration of Environmental Protection, and the Provincial Bureau of Quality and Technical Supervision, by having set up their own offices dealing with foreign investment related affairs, their working staff of related rooms should been dispatched to conduct work in the service building. b. Each department should send to the service building its own working staff with high familiarity with its profession, strong sense of service and discipline, and high understanding of the government policies. The staff working in the building shall be fixed with assignment and responsibility, and make the specially assigned job with specified person for relatively stable period. The change of director of each room is in principle in three-year term, and general working staff should complete one-year work before being transferred. c. The Provincial Economic Cooperation Office is responsible for conducting the annual checking-up of achievements of the working personnel dispatched by the relevant departments. The results of the checking-up will be the basis for the annual public servant checking-up, the consideration of rewards and penalties, and the posting of the dispatched working staff by the relevant departments. Each department should respect the conclusions of the checking-up by the Provincial Economic Cooperation Office. (3). The establishment of standardized and transparent office work system a. The establishment of efficient work institution The participating departments in the service building should, in accordance with the principle of improvement of government administration and the requirement of transforming the style of work effectively and raising the work efficiency, streamline and reorganize the internal application approval links, and authorize fully the working staff in the service building. For those departments allowing the using of their special stamp for application approval in the building, their working personnel in the building may use the special stamp directly on the application formalities and issue the certificate. For those departments not allowing the using of their stamps in the building, they should adopt concrete measures to ensure the approving work within their responsibility be completed in the building. In order to ensure the smooth functioning of various departments inside, the service building provides each office room with a computer which is connected with the computer network linking all the office rooms. The cost of purchase and operation of the equipment will be covered centrally by the Provincial Economic Cooperation Office. b. The adoption of the public notice, the working time limit and the leading department responsibility systems The service building sets up the Service Guide of the Yunnan Provincial Foreign Investment Service Building. In accord with the principles of the open government administration, the public notification of the administrative affairs, the open promise undertaking, and being under the supervision of the society, the service building will make open its office work system and the content, make explicit the procedures of application handling and the required materials and references, undertake the promised work time limit, and make public the bases for relevant charges and the criteria. For affairs belonging to joint handling, the leading department should, by effectively fulfilling its responsibility and actively seeking the coordination with other related departments, provide solution to the problems or the replies within specified work time limit. For those projects considered important projects at the provincial level, the working staff of the building should provide door-to-door service. c. The setting up of joint project approving and coordination meeting system The service building formulates the Provincial Approving Work Procedure for Foreign Investment Project in Yunnan Province and sets up the project joint approving and coordination meeting system. The Provincial Department of Foreign Trade and Economic Cooperation is in charge of the approving work of the foreign invested projects. If there are different opinions by more than two departments concerning an important project, the Provincial Economic Cooperation Office will take the lead to organize coordination. Decisions reached by the coordination meeting must be strictly followed by the relevant departments. The project approving work should ensure that all the approving formalities will be completed within 15 work days starting from the date the application is officially accepted. d. By actively seeking the improvement of their style of work, observing discipline, providing warm service, speaking politely, the working personnel of the service building should continuously raise the efficiency of their work and strive to provide high quality service to the investors. The Foreign investment Office shall strengthen the management towards the composing departments in the service building, and, together with the disciplinary commission and the department of supervision, conduct the activities of the democratic appraisal of the style of work and the open rectification and reform of all the work rooms in the building. 6. This operational guide is effective from the date of its publication. In case that in the document of YUN ZHENG BAN FA [2000] 160 by the Yunnan provincial government there are points which might not be in keeping with the spirit of this present guide, this present guide will supersede. Yunnan Association Of Enterprises With Foreign Investment Established on August 28, 1992 with the approval of Yunnan Provincial Government , the Yunnan Association of Enterprises with Foreign Investment ( hereinafter referred to as YAEFI ) is a non-profit-earning social organization consists of the following members: enterprises with foreign capital which is approved to be established by Yunnan Province, enterprises set up by compatriot from Hong Kong , Macau, Taiwan and Overseas Chinese, as well as those non-profit-earning corporate body. Yunnan Provincial Appeal Center for Foreign-Invested Enterprises To save the time and energy of foreign investors and foreign-invested enterprises, and to protect their legal rights, the Yunnan Provincial Government set up this center in 1997 in its Supervision Bureau. Foreign investors can lodge complaints with the center if they think that any official has committed acts contrary to China¡¯s laws, regulations, policies or government orders, or infringing upon their legal rights. The center is responsible for hearing foreign investors¡¯ complaints, solving their problems and even making judgments if the client so requests.
