Function of Provincial Department of Commerce

1. Implement the national development strategy, gridlines and policies on both foreign and domestic trade, international economic cooperation and investment invitation: to formulate development strategies, guidelines and policies of domestic and foreign trade and international economic cooperation in Yunnan Province, draft laws and regulations governing domestic and foreign trade, economic cooperation and foreign investment in Yunnan Province, devise implementation rules and regulations.
2. To formulate development plans for domestic trade of Yunnan Province, study on and put forth proposals on reforming the commercial distribution system, foster and develop urban and rural markets, promote the restructuring of the commercial distribution sector and the improvement of such modern distribution modalities as chain store operation, modern logistics and e-commerce.
3. To reseorganize the adjustment of market supply of main consumer goods and regulation of the distribution of major means of production.
4. To implement and execute measures for arch into and formulate policies for regulating the market operation and distribution order, breaking up market monopoly and regional blockage, to set up and improve an integrated, open, competitive and orderly market system. To monitor and analyze market activities and commodity supply and demand,  the regulation of import and export commodities; catalogue and tender policy thereof; be responsible for codifying, organizing the implementation of import & export quota plan; to manage quota quantity and issue licenses;
5. To formulate and execute policies concerning trade in technology, state import and export control, and policies encouraging the export of technology and complete set of equipment; to push forward the establishment of foreign trade standardization system; to supervise technology import, equipment import, export of domestic technologies subject to state export restriction and re-export of imported technologies, and to issue export licenses pertaining to nuclear non-proliferation.
6. To implement the national laws, regulations, guidelines and policies related to the “open to the outside” and investment invitation and so on. Draw up and carry out the policy & reform plan for foreign investment, meanwhile guide the work of foreign investment in Yunnan Province. Participate in the drawing up of long-run provincial foreign investment utilizing plan. Take charge of the foreign investment projects which are encouraged by province and above the limited investment line and the affairs for the establishment & registry of foreign-invested enterprises in special area which has been checked & approved by the commercial authorities on provincial level as well as the alteration about it, but also the set up of foreign-invested enterprises in special area those satisfied the following situations, regulated by nation, as investment amount, ownership or nature of the enterprise even the limitation on quota and the administration of license as well as the auditing & hand in of its alteration. Province-widely auditing and approve the contract & constitution of large-scaled foreign invested project also the key alteration affairs be regulated by laws. Supervise the implementation of law, regulation, rule and contract & constitution by foreign invested enterprises. Take charge of the statistic of provincial foreign indirect investment utilization and productive situation of foreign invested enterprises. Examine and approve the import and export license of foreign invested enterprise base on the commodity administrative limitation.
7 To organize and coordinate the work pertaining to antidumping, countervailing, safeguard measures and other issues related to fair trade for import and export. To institute a fair trade early warning mechanism for import and export, and organize industry injury investigations. To guide and coordinate domestic efforts in responding to foreign antidumping, countervailing, and safeguard investigations and other issues concerned.
8 To give general guidance to provincial efforts in foreign investment. To analyze and look into Yunnan’s foreign investment developments  and  submit information concerning the developments and the corresponding proposals to Yunnan government on a regular basis. To draw up and enforce foreign investment policies and reform schemes, participate in the formulation of mid-term and long-term planning and development strategies for foreign investment utilization. To examine and approve, according to relevant laws, the establishment and changes thereafter of foreign-invested enterprises with foreign input exceeding the state fixed amount, or engaged in restricted business areas, or in businesses subject to quota and license administration. To verify the contracts and statutes of large-scale projects with foreign investment and their major subsequent changes particularly stipulated in relevant legislations. To supervise the enforcement of laws, regulations, contracts and statutes by foreign-invested enterprises. To guide and oversee provincial efforts in attracting foreign investment and other business opportunities, as well as the establishment and trade performance of foreign-invested enterprises in China. Guide & administrate the investment invitation, investment promotion and the application approval of foreign invested enterprise and the import & export in Yunnan Province as well as comprehensively harmonize & guide the relevant affairs of state-level & province-level development zone.
9 To be responsible for China's foreign economic cooperation efforts. To formulate and implement policies and regulations on foreign economic cooperation, guide and monitor the regulation of overseas contract projects, labor cooperation and designing and consulting businesses. To work out administrative measures and specific policies guiding Yunnan’s overseas investment. To approve Yunnan’s companies to invest in and set up overseas establishments (excluding financial companies) and supervise their operation.
10 Take charge of the establishment & management of those permanent commercial institutions in Yunnan Province, which belong to Hong Kong, Macao, Taiwan and rest of the world.
11 To be responsible to formulate the stipulate of our province economics and trade which touch on foreign affairs; to manage and examine the assignment of all the members in Yunnan who will trade and study abroad and the invitation of foreign merchant; to manage all the economics and trade, which is involved the foreign countries; to be responsible for the reception work of participate in the foreign government, the international organization economics and trade delegation and the important foreign businessman.
12 To be responsible to instruct our province correlation work as well as port plan, construction.
13 To be responsible to instruct the work of the directly division and our province import and export commerce association and the related association、academy.
14 Undertake the other work assigned by the Government of Yunnan Province.
